(Lexington, KY) - The Kentucky Horse Racing Commission wants a federal court to dismiss a lawsuit filed by Maximum Security's owners.
The suit seeks to have Maximum Security reinstated as the winner of last month's 145th Kentucky Derby at Churchill Downs.
The horse's owners filed suit against the Kentucky Horse Racing Commission saying the disqualification was a violation of their constitutional rights.
The Commission filed a motion on Saturday in U.S. District Court in Lexington saying the ruling by race stewards can't be appealed.
